Trust & Estate Litigation Attorney

Position Overview
We are seeking a Trust & Estate Litigation Attorney to represent clients in contested probate, trust, and fiduciary disputes. The ideal candidate will lead litigation from intake through resolution, develop case strategy, and advocate for clients in court, mediation, and settlement negotiations. This role requires deep knowledge of trust and estate law and strong civil litigation skills to handle complex, fact- and law-intensive matters efficiently and professionally.

Key Responsibilities

  • Manage a diverse caseload of trust, estate, guardianship, and fiduciary disputes from intake through trial and appeal.
  • Develop litigation strategy, draft pleadings, motions, and briefs, and handle all aspects of pretrial practice including discovery and evidentiary matters.
  • Represent clients at hearings, mediations, settlement conferences, and trials; prepare witnesses and present evidence effectively in court.
  • Conduct legal research and draft clear, persuasive memoranda and legal filings addressing probate, trust administration, breach of fiduciary duty, undue influence, and will contests.
  • Take and defend depositions, prepare expert witnesses, and coordinate with forensic accountants and other specialists as needed.
  • Manage client relationships by providing timely case updates, strategic counseling, and realistic assessments of risks and outcomes.
  • Coordinate with transactional estate planners, estate administrators, and outside counsel on complex or multi-jurisdictional matters.
  • Supervise and mentor junior attorneys, paralegals, and support staff; review work product and delegate tasks to meet deadlines.
  • Assist with business development, client intake, and firm marketing efforts related to trust and estate litigation matters.

Qualifications

  • Civil litigation experience with a substantial focus on trust and estate matters (probate, trust administration, fiduciary disputes).
  • Proven courtroom experience, including hearings, motion practice, and trial advocacy.
  • Strong drafting, legal research, and oral advocacy skills; ability to produce persuasive pleadings and briefs under deadline pressure.
  • Demonstrated experience managing discovery, taking and defending depositions, and preparing witnesses for testimony.
  • Familiarity with probate and trust codes, fiduciary duties, statutory accounting, and remedies available in estate litigation.
  • Ability to manage multiple matters simultaneously, prioritize tasks, and meet deadlines in a fast-paced environment.
  • Excellent interpersonal skills, client-focused approach, and the ability to work collaboratively with colleagues and outside experts.
  • Nice to have: direct experience with complex estate disputes, multi-party litigation, and extensive deposition practice.
