Position Overview
We are seeking a Labor & Employment Associate Attorney to join our management-side employment law practice. The successful candidate will represent employers in employment litigation and provide proactive counseling on workplace issues, compliance, and risk management. This role combines courtroom advocacy, internal and regulatory investigations, policy drafting, and client counseling to help employers navigate discrimination, harassment, retaliation, wage and hour, and wrongful termination matters across federal and state law.

Key Responsibilities

  • Manage a caseload of employment litigation matters from inception through resolution, including drafting pleadings, motions, discovery responses, and briefs.
  • Represent clients in mediations, arbitrations, hearings, and court appearances; prepare witnesses and take and defend depositions.
  • Advise clients on employment-related policies and compliance with federal, state, and local laws (e.g., Title VII, ADA, ADEA, FMLA, FLSA).
  • Conduct workplace investigations into allegations of discrimination, harassment, retaliation, and other employee misconduct; prepare investigation reports and remediation recommendations.
  • Provide day-to-day counseling to HR and management on discipline, performance management, terminations, accommodations, leaves of absence, and discipline documentation.
  • Develop and deliver training to clients on harassment prevention, discrimination law, wage and hour compliance, and best HR practices.
  • Work with clients to design and revise employee handbooks, employment agreements, severance agreements, and internal policies to reduce legal risk.
  • Collaborate with partners and other practice groups on case strategy, complex matters, and appellate issues when necessary.
  • Manage client communications and expectations; prepare billing, case status updates, and settlement analyses.
  • Support business development efforts through client meetings, pitch materials, and contributing to thought leadership and firm visibility.

Qualifications

  • Juris Doctor (J.D.) from an accredited law school and active membership in the NJ state bar; bonus points for NY admission
  • 3+ years of experience handling employment/labor matters on the management side; litigation experience strongly preferred.
  • Demonstrated experience in employment litigation, including drafting motions, taking depositions, and courtroom appearances.
  • Experience conducting workplace investigations and preparing written investigation reports and recommendations.
  • Knowledge of key employment laws and regulations, including Title VII, ADA, ADEA, FMLA, FLSA, and state-specific employment statutes.
  • Strong legal research, writing, and analytical skills with attention to detail and deadlines.
  • Excellent interpersonal and client counseling skills; ability to present complex legal issues clearly to HR and senior management.
  • Proven ability to manage a diverse caseload and prioritize competing demands while maintaining high-quality work product.
  • Familiarity with workplace issues including discrimination, harassment, retaliation, wage and hour claims, wrongful termination, and employment disputes.
