Pre-Litigation Attorney

Position Overview
We are seeking a driven Pre-Litigation Attorney to manage and resolve personal injury claims before they reach formal litigation. The ideal candidate will lead pre-suit investigation, client counseling, demand preparation, and settlement negotiations to achieve timely, cost-effective outcomes. This role combines legal analysis, negotiation, and case management with frequent interaction with clients, insurers, medical providers, and experts.

Key Responsibilities

  • Handle a caseload of personal injury matters in the pre-litigation phase, including motor vehicle accidents, trucking accidents, and workplace injuries.
  • Conduct thorough factual and legal investigations: gather and review police reports, medical records, witness statements, and other relevant evidence.
  • Prepare and draft demand packages, settlement proposals, correspondence, and pre-suit pleadings as needed.
  • Negotiate with insurance adjusters and defense counsel to resolve claims favorably and efficiently.
  • Provide clear, compassionate counsel and regular updates to clients regarding case strategy, timelines, and settlement options.
  • Coordinate with medical providers, vocational experts, accident reconstructionists, and other consultants to develop case value and causation.
  • Evaluate liability and damages, calculate reserves, and recommend settlement authority to supervising counsel or management.
  • Manage all case-related documentation and deadlines within case management and document systems to ensure compliance with firm policies and statutes of limitations.
  • Identify cases requiring litigation and assist litigation teams with file turnover, including drafting litigation memoranda and preparing transfer packages.
  • Maintain professional relationships with referral sources, adjusters, and medical vendors to facilitate case resolution and client care.

Qualifications

  • Juris Doctor (JD) from an accredited law school and active bar admission in the relevant state.
  • Experience practicing personal injury law with a primary focus on pre-litigation case handling.
  • Demonstrated proficiency in pre-litigation matters: conducting investigations, preparing demands, and negotiating settlements in personal injury cases.
  • Strong knowledge of insurance practices, liability law, medical terminology, and damages calculation.
  • Excellent written and oral communication skills, with the ability to advocate effectively and compassionately for clients.
  • Proven organizational skills, time management, and ability to manage a high-volume caseload while meeting deadlines.
  • Comfortable using case management and document systems, and basic legal research tools.
  • Ability to work independently and collaboratively within a team; sound judgment and ethical standards.
  • Nice-to-have: specific experience handling motor vehicle accidents, trucking/complex commercial vehicle claims, and workplace injury matters.
  • Nice-to-have: trial exposure or experience assisting with litigation, depositions, and trial preparation.
